HON. EMMANUEL DUNG “GIBOK” Sues FG and DSS, Demands N5 Billion as Damages for Violation of his HUMAN RIGHTS

The former Jos South PDP Chairmanship Candidate, Hon. Emmanuel Dung Solomon fondly called “Gibok” through his Lawyer, Gyang Zi Esq has sued the Federal Government, the Department of State Security Services Headquarters and the Plateau State Command of the DSS over issues bordering on the infringement of his Fundamental Human Rights, his continuous detention, denial to access to his Lawyers and Relations.

The originating motions sighted by our medium was filed at the High Court of Justice Plateau State on the date 10th January, 2022.

The case is between Emmanuel Dung Solomon as Applicant and the Federal Republic of Nigeria, Attorney General of the Federal, the State Security Service as well as the Plateau State Command of the State Security Services who were all mentioned as Respondents.

The Applicant through his Council is praying the court for the following Seven (7) Reliefs:

  1. An order Enforcing the Applicant’s Fundamental Human Rights.
  2. An order declaring the arrest, humiliation, embarrassment, harassment, torture and detention of the Applicant from the 30th December, 2021 to 10th January, 2022 for a period of Twelve (12) days and still counting as illegal, unlawful and unconstitutional.
  3. An Order declaring the denial of the Applicant access to his Lawyers and Relations by the Respondents as unlawful, unconstitutional and a gross violation of the Fundament Human Rights of the Applicants.
  4. An Order directing the Respondents to release the Applicants from their Custody forthwith.
  5. An order against the Respondents to pay the Applicant the sum of N5,000,000,000. 00 (Five Billion Naira) only as general damages/compensation for the unlawful arrest and detention of the Applicant for a period of Twelve (12) days and still counting for no Just Cause as at the time of filing this case.
  6. A Mandatory Order directing the Respondents to publicly apologize to the Applicant in at least two National Dailies for unlawful violation of the Applicant’s Fundament Human Rights.
  7. An Order of injunction Restraining the Respondents, their agents, privies and representatives from further arresting and or detaining the Applicant for no just cause.

And for such further Order (s) the Court may deem fit to make in the circumstance.

Mr. Gyang Musa Davou, Brother to the Applicant also deposed to an Affidavit in support of the Originating Motion decried the dehumanization of the Applicant saying they made efforts as Family to enquire why the Applicant was arrested and detained but were denied access to the premises of the 4th Respondent.

He said the Counsel of the Applicant was given access to the premises but was not allowed to see the Applicant.

He also frowned at how the Applicant was dragged, blindfolded and chained on his legs and hands to an unknown destination when he and the Counsel visited the the office of the 4th defendant on the 6th January, 2022.
