Alaibe vs Douye: Supreme Court to Give Ruling Tomorrow

The Supreme Court of Nigeria will tomorrow, Tuesday rule on an appeal instituted against Bayelsa Governor, Diri Douye, by his rival in the last gubernatorial primaries, Mr. Timi Alaibe.

The five-member panel which will be presided over by the Chief Justice of Nigeria, Justice Ibrahim Tanko Muhammad will hear the applications pending before the court and thereafter give their ruling.

Recall that shortly before the Peoples Democratic Party’s (PDP) primary election, Alaibe had dragged the party to Federal High Court, Port-Harcourt, Rivers State. His grouse was with the composition of the 3-man panel appointed to conduct the primary.

The court however declined jurisdiction in the matter.

After losing out to Sen. Diri Douye in the primaries, Mr. Alaibe proceeded to the Federal High Court, Owerri, praying the court to nullify the primary election which Diri won. The Court again declined his prayers.

Not satisfied with the high court judgment, Alaibe moved to the Court of Appeal sitting in Owerri. The Appeal Court also dismissed his appeal while ruling against fresh governorship primary election.

Not relenting, Alaibe approached the apex court. He is praying the court to declare him the duly elected governor of Bayelsa State.

The matter was however stalled at the last hearing as the Supreme Court asked Alaibe’s lawyer, S.T. Ologunorisa, to regularise his processes, having withdrawn two applications which were not opposed by the lawyers to the defendant, Emmanuel Enoidem and Chief Chris Uche (SAN).

Tomorrow’s hearing follows from the regularisation of the processes by the appellant’s Counsel.
