PONSAH FANAP vs FR. DAMA (TINCITY FM JOS): WE HAVE ADVISED OUR CLIENT TO PAY PONSAH, COUNSEL TELLS COURT

The case between, Mr. Ponsha Fanap, a Journalist and an On-Air-Personality (OAP), against Rev. Fr. Martins Dama, the owner of Tincity Fm Jos has taken a new turn, as the Counsel to Dama has told the Plateau State High Court today that, the Defendant, Rev. Dama has been advised to pay Mr. Ponsah his unpaid salaries.
The case, which came up for hearing today, under the general course list, saw Mr. Ponsah, ready to testify by himself on the matter before the Court, especially on his statement of claim.
Speaking on the matter, the Defense Counsel to Rev. Dama, urged the Court to grant one last adjournment to enable parties resolve the matter.
The Counsel said, “It is true that the matter is fixed for hearing today. However, I am informed by the Counsel handling the matter to the effect that, he has pressured and advised his client to pay the outstanding and unpaid salaries and entitlements of the Plaintiff.
“As a result of the misunderstanding of the pressure put in to compel the Defendant to pay the outstanding that is why we have failed to file our Statement of Defense.
“The Defendant was suppose to be in Court today, but he is sick and has travelled out of the country for treatment.
“We don’t know, if he has taken the advice or whether he has kept enough money substantial for the settlement of the outstanding.
“We therefore urge the Court for just one last adjournment to present to the Court, the amount he has gathered to enable us pay the Plaintiff.”
Counsel to Mr. Ponsah, Deborah Manasseh (Esq), in her response to the application, vehemently opposed the application for adjournment, urging the Court to deliver judgment in the matter.
However, in the Court’s Ruling, the Court held that, for the interest of justice, the Defendant should be given one last adjournment and when he fails, the Plaintiff, Mr. Ponsah, would be given his right to prove his case.
The matter has been adjourned to the 11th of March 2020.
