The supreme court of Nigeria sitting in Abuja has upturned the judgment of the court of Appeal, Jos division, delivered on 19th August which set aside the Ruling of the Plateau State Governorship Tribunal which allowed petitioner’s witnesses who were not listed in the petition to testify during trial.
Delivering judgment on the matter, the supreme court by a panel of 5 justices headed by Bode Rhodes-Vivor JSC, held that the court of Appeal in its said judgment was in error to have dismissed the Interlocutory appeal of the Plateau state Governorship candidate of the PDP, Jeremiah Useni.
The court earlier on unanimously dismissed the preliminary objection of Governor Simon Lalong and the All Progressive Congress APC, Challenging the competence of the Appeal by Jeremiah Useni and the PDP.
Having held that the Appeal was competent, the supreme court proceeded to hear the main appeal and ruled in favour of the Appellant, Useni.
By the said judgment the supreme court affirmed the Ruling of the Governorship Election Petition Tribunal which held that the testimony of the Petitioner Witness 12, who testified as AAQ was very much in order.
The judgment is to be served on the 3-Man Governorship Tribunal for Plateau state before delivering their final judgment on or before the 9th of October 2019.
