Decisions Made by the Presidential Election Petition Court (PEPC) so Far

The Presidential Election Petition Court (PEPC) is set to deliver a consolidated Judgment on the petitions filed by the Peoples Democratic Party (PDP), Labour Party (LP), Allied Peoples Movement (APM) and their Candidates challenging the declaration of President Bola Tinubu and Vice President Kashim Shetimma by the electoral umpire, INEC.

So far the following decisions have been made by the Presidential Election Petition Court:

The Presidential Election Petitions Court declared that it lacks the powers to hear the petition of the Allied Peoples Movement (APM) challenging the qualification of President Bola Tinubu and Kashim Shettima.

PEPC struck out the introduction of new issues in the Allied Peoples Movement’s Reply to Respondents motion for lack of jurisdiction

PEPC held that nomination and qualification of Candidate in an Election is a Pre-election Matter and only an Aspirant that contested the Primaries can challenge the nomination of a Candidate and that must be done within 14 days from the date of the election and no Political party can do that.

It also said the Allied Peoples Movement (APM) Lacks the Locus Standi to Institute Matters bothering on Nomination and sponsorship of Vice President, Kashim Shetimma.

PEPC disclosed that the Petition of Allied Peoples Movement bordering on the alleged Multiple Nomination of Vice President, Kashim Shetimma is an Abuse of Court Process.

Based on the decisions above, it dismissed the Petition filed by APM.

PEPC held that Labour Party filed a petition on electoral malpractices in most polling units but couldn’t prove any malpractices in any polling unit.

It said “Peter Obi and LP claimed to have scored the majority of lawful votes cast, they failed to state the number of lawful votes they scored.
The determination of election is about figures”

They also failed to prove that their votes were suppressed by failing to specify the number of votes suppressed.”

On Membership, the PEPC held that Peter Obi is a Member of Labour Party (LP).

Meanwhile, the PEPC has also dismissed the petition of the PDP and LP Candidate challenging the qualification of President Bola Tinubu.

At the time of filing this report, Justice Haruna Tsamani was still delivering verdict on Petition of Peter Obi and the Labour Party.
