Justice Haruna Tsamani, who is presiding over the Abuja division, is sitting on a case alongside two other honorable justices of the Appellate court. The case is filed by Hon. Muhammed Alkali of the People Redemption Party against INEC and Musa Avia Agah of the People’s Democratic Party. Additionally, Gyang Yaya Zhi of the Labour Party vs Simon Mwadkwon  of the PDP and INEC are involved in the case.

Gyang Zi of the Labour Party and Adamu Alkali of the People Redemption Party are seeking a review of the Court of Appeal’s judgment. They are asking the court to declare them as the winners of the election held on March 18, 2023, as they had the second majority of lawful votes. They argue that the court’s declaration for a rerun election was made in error, as 28 cases in the appeal court favored the second runner-up. On the other hand, Hon. Isaac Kwalu, who was sacked as a member of the Quanpan, Mikang, Shendam federal Constituency, is seeking a review of the judgment, claiming that it is a pre-election matter.

The appeal court is currently considering whether it has the authority to hear the matter after the 60-day period of the election petition tribunal at the appellate court has elapsed. The council for Alkali Adamu argues that the appellate court has the right to reverse its judgment, citing numerous legal authorities. They point out that out of the 28 decisions taken by the court, only two are calling for a rerun.

Isaac Kwalu’s council has also approached the court, requesting a review of the judgment that sacked Kwalu and issued a certificate to Chief John Dafa’an. On the other hand, John Dafa’an’s council argues that the court, as a creation of the constitution, is bound by the constitution and therefore lacks jurisdiction to amend its own judgment. They contend that the time to entertain election appeals falls within 60 days, which has already been done, and the court cannot be invited to review its decisions after this period.

The main question now is whether the court has the jurisdiction or foundation to entertain matters of post-judgment after the 60-day period. After the session, Barr. Gyang Zi expressed optimism that he would receive justice and called on his supporters to be prepared for the rerun election and not to pay attention to the propaganda being spread.
