Plateau State High Court in Barkin Ladi Local Government Council of the state presided over by Justice S.P. Gang has struck out proceedings by the Peoples Democratic Party (PDP) in respect of Langtang North local government election.
It would be recalled that following the conduct of Plateau State local government election on the February 25, 2014, the electoral officer of Langtang north announce the results of all the ward but one, while Plateau State Independent Electoral Commission (PLASIEC) ordered a rerun for Jat ward.
But, PDP went to court to compel PLASIEC to add the result of Jat ward and declare the result of Langtang North LGC election.
It is against this background that the DPP and its candidate in the election, Hon. Dan Dul, applied to the court to be joined in the case.
The court granted the order and joined the DPP and its candidate Hon. Dan Dul as 3rd and 4th defendants as they filed a preliminary objection challenging the jurisdiction of the court to hear the PDP motion of mandamus because the subject matter had to do with election and only the election petition tribunal has the jurisdiction to entertain it and not the high court.
Justice Gang in his ruling yesterday in respect of the preliminary objection filed by DPP and its candidate Hon. Dan Dul said the court found the preliminary objection meritorious and successful and held that it had no jurisdiction to hear the motion of mandamus filed by PDP and proceeded to strike out the mandamus proceedings.
