FEDERAL HIGH COURT, JOS, DELIVERS JUDGMENT IN PRE-ELECTION DISPUTE BETWEEN HON. ESTHER DANBOYI AND HON. DACHUNG BAGOS
The Federal High Court sitting in Jos today delivered judgment in the pre-election dispute between Hon. Esther Danboyi and Hon. Dachung Bagos.
In the suit instituted on behalf of Hon. Esther Danboyi by R. T. Yilwatda, Esq., of Gyang Zi, SAN & Co., the Court dismissed the Notice of Preliminary Objection and counter-affidavits filed by the 1st Defendant, through her counsel, Niri Darong, and the All Progressives Congress (APC), represented by A. O. Usman, describing them as frivolous and unmeritorious.
The Court further reaffirmed that the relevant provisions of the Constitution, the Electoral Act, and the APC Guidelines governing primary elections were not complied with. Consequently, the Court found that the required elections had not been conducted in the wards complained of by the Plaintiff.
Accordingly, the Court ordered that elections be conducted in the affected wards within 30 days and awarded ₦500,000 in costs against each Defendant, payable to the Plaintiff.
The judgment underscores the importance of strict compliance with constitutional provisions, electoral laws, and the guidelines of political parties in the conduct of primary elections.
Justice must not only be done; electoral processes must also comply with the law.
