A Jos division of the Federal High Court yesterday struck out a pre-election matter pending before it against Hon. Suleiman Yahaya Kwande.
Hon. Ibrahim Dasuki NaKande, had in a suit no. FHC/J/CS/2/2015 challenged Kwande’s return as the validly elected candidate of the All Progressives Congress (APC), on the ground that the primary election was marred by irregularities.
Kwande is a Federal lawmaker representing Jos-North/Bassa Federal Constituency in the House of Representatives.
The court presided over by Justice D. Y. Agishi, struck out the matter on the basis of none appearance by the plaintiff.
In her ruling, Justice Agishi said since the plaintiff has not been putting appearances after some adjournment, the matter is struck out.
She awarded the sum of fifty thousand naira as cost against the plaintiff.
Lead counsel to the defendant, Barrister Tony Agaga said that the plaintiff has lost interest in the matter, and therefore “we plead for the suit to be stricken out of it.”
