The Judiciary is said to be “the last hope of the common man (oppressed)”, but it seems that this statement might be in contradiction to some who are seeking justice in the Plateau State high court of Justice. Before his lordship, Justice Arum Ashom of court 6 plateau State High court of Justice, in a matter of motion on notice against the Registrar of the Plateau State High court, Mrs Ladi Madaki , P.M Lere Esq, Hon Bala Shehu Chairman of Jos North and other defendants on alleged contempt
The plaintiffs- Mr Godwill Jahota Jiwul, Engineer Solomon Jahota Jiwul, Walter Jahota Jiwul ESQ, Mrs Magaret L. Bulus, Mrs Sarah Pennap, Barr. Grace Akpan (Mrs), Miss Regina Jahota Jiwul file an order committing the contemnors to wit: Mrs Ladi A Madaki (“Acting Chief Registrar). Panmak Mark Lere, Esq (“council to the 2nd to the 10th contemnors”), Hon Shehu Bala, Parisa Jahota Jiwul, Bala Gotom, Ade Musa Ajota, James Jahota jiwul, Emmanuel Jahota Jiwul, Jonathan Jiwul, Sabastian Kopshang, Ignatius Gambar, Dimka Williams to prison for contempt “ex facie curie” (committed out of sight and hearing of honourable court), in connection with: The order of injunction of Honorable Justice I. I Kunda, granted on the 8th November 2019 in relation to suit No. PLD/J578/2019 (‘order of injunction”) and the Consent Judgment of the Honorable Justice D.G Mann, entered on the 7th March 2018 in suit No.PLD/J287/2015 ( “Consent Judgment”)
The Registrar Mrs Ladi A. Madaki and the council P.M Lere. Esq “have remained contemptuous of the order of injunction” by failing to produce the Honorable Justice I.I Kunda’s court any paper being or purporting to be a testimony in their possession and /or under their control, in connection with Late Chief (Dr.) Anthony Jahota Jiwul Including Late Chief Jiwul’s corpse Disposition document and /death certificate (“the Testamentary document’s”)
Other grounds upon which the plaintiff application is that the registrar, Mrs Ladi A Madaki, and council P.M Lere Esq have been using the testamentary documents to hinder the course of justice in the order issued by Honorable Justice I. I Kunda. Again, the plaintiff submits that Mrs Ladi A. Madaki and P.M Lere, Esq have continued to encourage the 2nd to 10th contemnors to continue to show gross disrespect to the honourable courts by using the testamentary documents for fraudulent transactions, including but not limited to using the testamentary document’s to fraudulently apply for a part surrender of Chalim house estate to Honorable Shehu Bala, the transition committee chairman of Jos North LGA without probate.
VPN gathered that the Transition Committee Chairman of Jos North, Hon Shehu Bala have since moved into the Chalim Estate. Our judiciary correspondence also gathered that the matter is slated for moving of motions for the 5th of February 2021 as the court could not seat today as the Judge was absent in court the clerk ask the councils to pick a new date.
One of the plaintiff says the action of the defendants portends a grave danger on the dignity, integrity, majesty and honor of the courts in Nigeria
