An aspirant of the All Progressives Congress in Plateau State, Abdul Saleh, has appealed to the court to nullify the election of Hon. Ibrahim Baba Hassan as the candidate for the seat of Jos North-North State constituency in the Plateau State House of Assembly. Saleh says he is the rightful candidate. 

In a suit filed at the Jos Division of the Federal High Court, counsel to the plaintiff, Ahmad S. Garba, named Hassan and the Independent National Electoral Commission as the 1st, 2nd and 3rd defendants. Saleh is seeking to nullify the nomination of Hassan and direct the APC to submit his name to INEC as the party’s candidate for the electn and for INEC to accept same.

The plaintiff in his originating summons averred that the 1st defendant has falsely sworn to an affidavit wherein he stated that he has fulfilled the entire constitutional requirement for him to contest in the said primary election of the party. Saleh further alleged that the plaintiff did not fulfill the required processes for him to be a card carrying member of the APC as at the time of party’s membership registration. He added that the plaintiff is still a member of the Labour Party since he has not declared on the floor of the House that he has decamped. He said this amounts to dual membership of two parties.

The plaintiff is seeking the court to declare that Hassan’s nomination is null and void and to further order that he is the legitimate candidate of the APC.
