Two men were on Thursday arraigned before an Upper Area Court in Jos and charged with homosexual behaviour. The men Emeka Eze aged 35 and Jonathan Akatin aged 22 who reside in Alheri Jos were charged with a one-count charge.

Gokwat Ibrahim who is the prosecutor stated in court that the accused committed the offence on September 7th at 10pm. He said that they were arrested by the police following a tip off by neighbours. He added “The accused have been committing the offence in their compound publicly, which is against the order of nature. During police investigation, the suspects confessed to the crime”.

The prosecutor said the act committed was an offence contrary to section 284 of the penal code and urged the court to issue a summary trial due to their confessional statements. He said “The court should rely on Section 157 (1) of the Criminal Procedure Code (CPC) that stipulates quick judgment for anybody who confesses to his or her crime”. He said investigation was on-going and pleaded that the sentence should be reserved until the conclusion.

The accused pleaded guilty when the matter came up and begged for leniency saying they did not know it was an offence to indulge in homosexuality. Presiding officer, Mustapha Hassan ordered the accused to be remanded in prison and adjourned the case to October 10th.
